Can a doctor refuse me as a patient?

The short answer

A doctor can dismiss you as a patient, but only under strict conditions. The main reason is a seriously disrupted relationship of trust where cooperation is no longer possible. The doctor must motivate this well and cannot suddenly abandon you. There must always be a transition period in which you can find a new doctor. A doctor can never refuse you in an emergency.

What does the law say?

The Medical Treatment Contracts Act (WGBO) regulates the rights and obligations between doctor and patient. Doctors have a duty of care and can only terminate a treatment relationship for valid reasons. The professional guidelines for doctors state that continuity of care must be guaranteed. A doctor must always ensure responsible transfer to another healthcare provider.

What should you look out for?

A doctor must always have a valid reason and may not discriminate against you based on age, gender, religion or other personal characteristics. Make sure the doctor informs you in writing about the termination and gives you enough time to find a new doctor. Check if there is an emergency situation, because then a doctor can never refuse you.

Example from practice

A patient repeatedly becomes aggressive towards the practice staff and consciously does not follow medical advice. After multiple warnings, the general practitioner decides to terminate the treatment relationship. The doctor sends a registered letter with an explanation and gives three months to find a new general practitioner. During this period, the doctor remains available for emergencies. This is a lawful dismissal because the relationship of trust is seriously disrupted.
